HB3032 by McClendon (Relating to the transportation of hazardous materials in high-threat areas; providing a penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require the Texas Department of Public Safety (DPS), in consultation with the Division of Emergency Management in the Office of the Governor, to designate high-threat areas that are prone to terrorist attacks. DPS may also enter into cooperative agreements with agencies of this state, other states, and the United States.

The bill would provide conditions under which a person could not transport hazardous materials, except if the person holds a permit. The bill would also provide an exception to an emergency situation if the department determines that the emergency is temporary.

The bill would take effect immediately if it is passed by two-thirds votes of all members of each house. Otherwise, the bill would take effect on September 1, 2007.
