No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code to grant a judge authority to issue an order allowing an adult with care, custody, and possession of a minor to consent on the minor's behalf for the minor to obtain an abortion. The bill would grant the adult a right to an appeal if the application is denied.

Provisions of the bill would apply only to an abortion performed on or after January 1, 2008. The Texas Supreme Court would be required to promptly issue any rules necessary to conform to the change in law made by the bill. Not later than the 60th day after the effective date of the bill, the clerk of the Texas Supreme Court would be required to amend the application form and notice of appeal form to be used as indicated in the bill as well as develop the application form for the adult seeking consent to an abortion on a minor's behalf.

The bill would take effect September 1, 2007.

The Office of the Attorney General anticipates there would be challenges to the provisions of the bill; however, any addition to the agency's caseload could be absorbed using existing resources. The Office of Court Administration indicates provisions of the bill that would affect the Texas Supreme Court would be insignificant, as well.
