The bill would amend the Occupations Code to add a pharmacist who practices in or serves as a consultant to a penal institution as a pharmacist who may return to a pharmacy certain unused drugs. The bill would amend the definition of a charitable medical clinic to include a patient assistance program or charitable pharmacy and exempt a charitable donor from the requirement which requires a wholesale distributor of prescription drugs license.
Based on information provided from the Board of Pharmacy, the Department of Criminal Justice, and the Department of State Health Services, it is assumed that any additional costs related to the duties and responsibilities associated with implementing the provisions of the bill could be covered by utilizing existing resources.
The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house, otherwise the bill would take effect September 1, 2007.
