No significant fiscal implication to the State is anticipated.

The bill would add Section 411.1406 to Subchapter F, Chapter 411 of the Government Code to authorize a county attorney in a county with a population of 3.3 million or more to obtain from the Department of Public Safety (DPS) certain criminal history records.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

Based on the 2000 U.S. Census, the bill would apply only to Harris County. DPS estimates that providing the applicable records to Harris County could be achieved utilizing existing resources.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
