No fiscal implication to the State is anticipated.

The bill would amend Chapter 372 of the Local Government Code regarding procedures for establishing, adding or excluding area of, funding, and making assessments and payments for a public improvement district and improvement projects.

The bill would specify that a district under Subchapter C would be created under Section 52, Article III, and Section 59, Article XVI, Texas Constitution. Section 52, Article III would provide authority for issuing bonds and levying taxes for certain purposes, and Section 59, Article XVI would provide the district with the powers and authority of a conservation and reclamation district.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
