The bill would amend the Civil Practice and Remedies Code to repeal Section 41.0105 relating to the recovery of medical or health care expenses in a civil action. The section repealed provides that in addition to any other limitation under law, recovery of medical or health care expenses incurred is limited to the amount actually paid or incurred by or on behalf of the claimant. To the extent the bill would change guidelines on recoverable amounts in civil actions, no significant fiscal implication to the State is anticipated. The bill would take effect September 1, 2007.
