LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 1, 2007

TO:
Honorable Wayne Smith, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3304 by Pena (Relating to certain correctional facilities that house only federal prisoners.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require a correctional facility contracting to house only federal prisoners and operating pursuant to a contract between the federal government and a county to comply with the provisions of Chapter 511 of the Government Code. Under current statute, a county correctional facility operated as described is excluded from those requirements.

The proposed change in statute could add facilities to those for which the Commission on Jail Standards would be required to provide reviews of construction documents; however, because the commission may charge fees to cover associated costs, provisions of the bill could be absorbed using existing resources.

The bill would take effect September 1, 2007.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
