No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code and the Local Government Code to authorize the county clerk in a county with a population of 570,000 or more and any part of which is located within the Lower Rio Grande Valley adjacent to an international border to charge a fee that exceeds the fee charged by the bureau of vital statistics for the issuance of a certified copy of a birth certificate or death certificate.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

Based on the geographical and population criteria in the bill and using the 2000 U.S. census (as required by Section 311.005, Government Code), the bill would not currently apply to any county. It is assumed, however, based on current unofficial population estimates, that upon publication of the results of the 2010 U.S. census, the provisions of the bill would apply to Hidalgo County.


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
