No significant fiscal implication to the State is anticipated.

The bill would prohibit the Texas Commission on Environmental Quality (TCEQ) from granting a permit for the initial construction of a new electric generating facility (EGF) if emissions from the proposed facility would do any of the following: cause or contribute to air pollution in a nonattainment area; cause an area to be designated a nonattainment area; or negatively affect compliance with the state implementation plan. The bill’s provisions would apply only to EGF applications received on or after the effective date of the Act, September 1, 2007.

The TCEQ reports that it would not incur any significant costs in implementing the provisions of the bill.


Local Government Impact

The TCEQ reports that the bill should not have a significant fiscal impact on local governments owning or managing EGFs.
