May 3, 2007

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3459 by Paxton (relating to procedures relating to placement of a public school student in a disciplinary alternative education program.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would entitle students to due process and representation at a hearing to remove a student to a disciplinary alternative education program (DAEP).

The bill would require a principal to provide notifications to parents or guardians of a student's placement in a DAEP and of the student's right to appeal the placement.

Local Government Impact

School districts would be required to follow certain policies and procedures regarding placement of students in DAEPs, and could incur associated costs.
