LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION
Revision 1

April 3, 2007

TO:
Honorable Wayne Smith, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3516 by Creighton (Relating to publication of notice for certain transactions involving local governmental entities.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend various sections of the Local Government Code to allow local government entities to post for at least 14 consecutive days on the entity's Internet website notice for transactions that are under current statute required to be published in a newspaper. Publication in a newspaper would be required to be published just once instead of the currently required once a week for two consecutive weeks. If a local government entity does not maintain an Internet website, the entity may post in the business daily provided on the Internet by the Texas Building and Procurement Commission.

The bill would take effect September 1, 2007.

Local Government Impact

Local government entities would experience a savings from the reduced number of newspaper notices; however, the fiscal implication is not expected to be significant. For example, the Comptroller of Public Accounts received information concerning annual estimated savings from these entities: City of Conroe, $15,775; City of Giddings, $4,000; Upshur County, $2,000; and El Paso County, $50,000.
