No significant fiscal implication to the State is anticipated.

The bill would define Best Available Control Technology (BACT) for major air emissions sources to correspond to the definition as set forth by the US Federal Government. For other stationary sources the same definition would apply, with special consideration given to the technical practicability and economic reasonableness of achieving the emission limitations. Although the Texas Commission on Environmental Quality (TCEQ) current uses an approach slightly different from the federal definition for BACT, the agency reports that BACT reviews conducted under either system arrive at the same conclusions. Therefore, no signficant cost to the TCEQ is expected as a result of the bill's passage.
