April 10, 2007

TO:
Honorable Mike Krusee, Chair, House Committee on Transportation

FROM:

IN RE:
HB3608 by Hopson (Relating to persons placed on community supervision and drivers license revocation requiring electronic monitoring of driving activity.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require a court to require a person placed on community supervision for an intoxication or alcoholic beverage offense to wear an electronic monitoring device capable of providing to the court or the community supervision and corrections department data regarding the person's driving activity. The defendant would be required to pay for all or part of the cost of the device, based on the defendant's ability to pay. If the court determines that the person is unable to pay, the court would be allowed to impose a reasonable payment schedule not to exceed twice the period of the court's order.

The bill would take effect September 1, 2007.
