The bill would amend the Code of Criminal Procedure to authorize that a felony indictment may be presented within 10 years from the date of the commission of the offense of an improper relationship between an educator and student and 10 years from the 21st birthday of the victim of the offense, if the victim was in custody at the time of the offense and the victim was less than 21 years of age at the time the offense was committed.
The bill would also add three additional offenses to the list of offenses from another state, federal law, the laws of a foreign county, or the Uniform Code of Military Justice which may be used to determine if the offense contains elements that are substantially similar to a Texas offense and would require registration as a sex offender: (1) Online solicitation of a minor; (2) Improper relationship between educator and student; (3) Improper sexual activity with person in custody. To the extent the bill would amend guidelines for determining the statute of limitations or sex offender registration, no significant fiscal implication to the State is anticipated. The bill would take effect September 1, 2007.
There would be some costs to local law enforcement and local court systems to investigate and prosecute the newly eligible offenses. The costs would depend on the number of offenders.
