LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 11, 2007

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3723 by Elkins (Relating to the voting rights of residents in an area annexed for limited purposes under a strategic partnership agreement.), As Engrossed

No fiscal implication to the State is anticipated.

Under Section 43.0751(q), Local Government Code, Subchapter F (limited purpose annexation) does not apply to a limited-purpose annexation under a strategic partnership agreement. The bill would amend Section 43.0751(q) to make an exception relating to the effect of annexation on voting rights and eligibility for office.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
