No significant fiscal implication to the State is anticipated.

The bill would amend the Water Code to authorize any district or any petitioner seeking the creation of a municipal utility district to petition the Texas Commission on Environmental Quality (TCEQ) to acquire the power for the district to design, acquire, construct, finance, issue bonds for, and convey to this state, a county, or a municipality for operation and maintenance, a road that meets certain criteria. If the TCEQ were to issue an order approving the petition, the district would be allowed to undertake a road project if the municipality or county that would operate and maintain the road project, or the Texas Department of Transportation if the state would operate and maintain the road project, has approved the plans and specifications of the road project.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
