HB3770 by Puente (Relating to the acquisition of road powers by a municipal utility district.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Water Code to authorize any petitioner seeking the creation of a municipal utility district to petition the Texas Commission on Environmental Quality to acquire the powers for the district to acquire, construct, and finance a road that meets certain criteria. In addition, a district with road powers would be required to submit for approval the plans and specifications of road projects to the municipality or county that would operate and maintain the road. If a road project is to be operated and maintained by the state, the district would be required to submit the plans and specifications to the Texas Transportation Commission.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
