No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to authorize a municipality to engage in the sale of compost or mulch products in certain situations. The municipality would not be allowed to charge a price that is lower than the average of the prices offered by three private businesses to sell compost or mulch to customers inside the municipality's corporate limits. The municipality would be allowed to advertise within its corporate limits the sale of the products and would also be authorized to provide the products for free to its residents.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
