LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 15, 2007

TO:
Honorable Wayne Smith, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3834 by Gonzales (Relating to authorizing the amount of a fee charged by certain counties for issuing certain utility certificates.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to specify the amount of a fee that may be imposed by a county commissioners court for issuing certain utility certificates. Under current statute, the fee may not be greater than the amount of the fee imposed by a municipality for a subdivision that is located entirely in the extraterritorial jurisdiction of the municipality for a plat compliance certificate. The bill would set the fee at the greater of $30 or the amount of the municipal fee.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
