LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 1, 2007

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3892 by Burnam (Relating to the issuance of permits affecting air quality and notification of certain local officials.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require that notification be sent to the commissioners of the county and each member of the governing body of each municipality with a population of 500,000 or more that is located in the county for a facility that emits air contaminants and that is located or planned to be located in a nonattainment area when that facility applies for construction permits, amendments to a construction permit, special permits, or operating permits.

Although the bill would require a change in the application review process to gather information so that additional letters can be mailed or emailed to the appropriate officials, any costs to the Commission on Environmental Quality (TCEQ) qare not expected to be significant.

Local Government Impact

No fiscal implication to units of local government is anticipated.
