LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 11, 2007

TO:
Honorable Will Hartnett, Chair, House Committee on Judiciary

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3932 by Gallego (Relating to the office of district attorney for certain judicial districts.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Chapter 43 of the Government Code to change the territory served by certain district attorneys.

The bill would provide that the district attorney for the 83rd Judicial District, rather than the district attorney for the 34th Judicial District, serve Culberson and Hudspeth counties in the 394th Judicial District. The bill would delete the requirement that Culberson and Hudspeth counties each pay $100 per month to El Paso County for criminal affair matters of the district attorney's office for the 34th Judicial District. The bill would also provide that the district attorney for the 112th Judicial District also serves as the district attorney for the 83rd Judicial District in Pecos County.

On the effective date of the bill, the district attorney for the 34th Judicial District would transfer all matters for Culberson and Hudspeth counties to the district attorney for the 83rd Judicial District, and the district attorney for the 83rd Judicial District would transfer all matters for Pecos County to the district attorney for the 112th Judicial District.

The bill would take effect on September 1, 2013.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
