Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 30, 2007

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3965 by Martinez Fischer (Relating to duties of a parent in the parent-child relationship to report, creating an offense and providing a penalty and other family law matters.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 261, Family Code, to authorize issuance of a summons or an arrest warrant when a parent refuses to cooperate with an investigation of child abuse or neglect.  It would amend Chapter 161, Family Code, to require a parent whose rights have been terminated to cooperate with an investigatory request when the child is still in the home or custody of the parent.  It would amend Chapter 201, Family Code, to authorize issuance of a summons when a parent fails to appear to an authorized agency conducting an investigation.  The Department of Family and Protective Services indicates that any costs associated with the bill could be absorbed within the agency's existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
