No significant fiscal implication to the State is anticipated.
The bill would require the Department of Aging and Disability Services (DADS) to develop and implement a pilot program to increase the use of advance directives by nursing home residents by educating the residents about advance care planning. DADS would be required to submit a report to the Governor, Lieutenant Governor, Speaker of the House and appropriate standing committees no later than October 1, 2010, evaluating the effectiveness of the pilot with a recommendation to continue, expand, or eliminate the pilot program. The Health and Human Services Commission would be required to adopt rules for the implementation of this pilot program. Both agencies indicate that pilot costs could be absorbed within existing resources.
