LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

February 22, 2007

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB27 by Nelson (Relating to a pilot program to educate nursing home residents about advance care planning.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require the Department of Aging and Disability Services (DADS) to develop and implement a pilot program to increase the use of advance directives by nursing home and intermediate care facilities for the mentally retarded residents by educating the residents and the families about advance care planning. DADS would be required to submit a report to the Governor, Lieutenant Governor, Speaker of the House and appropriate standing committees no later than October 1, 2010, evaluating the effectiveness of the pilot with a recommendation to continue, expand, or eliminate the pilot program. The Health and Human Services Commission would be required to adopt rules for the implementation of this pilot program. Both agencies indicate that pilot costs could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
