LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

February 19, 2007

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB28 by Nelson (Relating to transferable physician orders for life-sustaining and related treatment.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the Department of State Health Services (DSHS) and the Department of Aging and Disability Services (DADS) to develop a form for transferable physician orders. DSHS and DADS indicate the form could be developed using existing resources.

It is assumed any rules necessary to implement the provisions of the bill would be developed using the existing resources of the Health and Human Services Commission, DSHS, and DADS.

The bill would establish administrative penalties for certain providers for a violation of law relating to transferable physician orders. It is assumed these penalities would not result in significant revenue.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
