TO: | Honorable David Dewhurst, Lieutenant Governor, Senate |
FROM: | John S. O'Brien, Director, Legislative Budget Board |
IN RE: | SB63 by Zaffirini (Relating to the powers of the commissioners court of certain counties that have no incorporated municipality. ), As Passed 2nd House |
The bill would amend Section 81.033, Local Government Code, to authorize additional powers to the commissioners court of a county with a population of more than 5,000 that is located within 100 miles of an international boundary and that contains no incorporated territory of a municiipality. Current statute authorizes those additional powers to the commissioners court of a county with a population of more than 7,500 that is located on an international boundary and that contains no incorporated territory of a municipality. The change in criteria would add counties to those to whom Section 81.033, Local Government Code would apply.
The bill would add Subchapter L to Chapter 231 of the Local Government Code regarding zoning around Falcon Lake.
No significant fiscal implication to units of local government is anticipated from the changes to Section 81.033.
Because the addition to Chapter 231 would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
