FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 13, 2007

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB120 by Zaffirini (Relating to the prevention of and education concerning the offense of online solicitation of a minor.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require the Texas State Safety Center at Texas State University-San Marcos, in consultation with attorney general and the commissioner of education, to maintain on the Center's website a link that enables an Internet user to access free of charge information and educational materials designed to prevent the commision of the offense of online solicitation of a minor. The bill provides that the education materials shall be age and content appropriate for school use. In addition, penalties are enhanced for violations of certain provisions of the Penal Code relating to online solicitation of a minor. The Center would be required to post the link by December 1, 2007. Texas State University-San Marcos indicates they will be able to implement provisions of the bill within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
