LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

February 5, 2007

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB204 by Nelson (Relating to certain electronic medical records systems.), As Introduced

No fiscal implication to the State is anticipated.

The bill requires any person providing electronic medical records software packages or systems to a person who administers immunizations in Texas, or to an entity that manages records for the person, to provide the ability to electronically interface with the immunization registry maintained by the Department of State Health Services and to generate electronic reports containing the fields necessary to populate the immunization registry (the Health and Human Services Commission may specify these fields by rule). The Office of the Attorney General is authorized to bring an action in the name of the state to enjoin a violation of these requirements and to recover on behalf of the state reasonable attorney's fees, court costs, and investigative costs if the state prevails in the suit. The agencies estimate that any cost could be absorbed with existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
