SB225 by Ellis (Relating to privacy of wireless telecommunications customer information; providing a civil penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Utilities Code to define wireless telecommunications customer information, to prohibit the sale and disclosure of that information without the customer’s consent, and to prohibit a person from obtaining wireless telecommunications customer information through fraud or misrepresentation. The bill would not prohibit the sale or disclosure of wireless or certain telecommunications customer information. The bill would authorize the Office of the Attorney General to collect a civil penalty of $5,000 for each customer whose information is obtained in violation of these provisions.

Based on the analysis of the Office of the Attorney General and the Public Utility Commission, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

This Act takes effect September 1, 2007.
