SB233 by Harris (Relating to the authority of certain law enforcement agencies to establish a checkpoint to determine whether persons are boating while intoxicated.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would add Chapter 65 to Title 1 of the Code of Criminal Procedure to authorize certain law enforcement agencies that patrol public waters in Texas to establish temporary checkpoints to determine whether individuals are committing the offense of Boating While Intoxicated. Law enforcement agencies would be required to keep a record of each operation of a checkpoint.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

According to the Parks and Wildlife Department, costs associated with implementing provisions of the bill could be absorbed using existing resources.
