No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code as it relates to the administration of polygraph examinations to certain commissioned officers and noncommissioned employees of the Department of Public Safety (DPS). 
 
The bill would amend Government Code, Section 411.007 (c) which would not allow commissioned DPS officers to be suspended, terminated, or subjected to any form of discrimination by the department due to the refusal to take a polygraph examination except for the provisions included in Government Code, Section 411.007 (c-1). 
 
The bill would amend Government Code, Section 411.007 (c-1), section 1 which could require DPS commissioned officers and noncommissioned employees to take a polygraph examination if the officer or employee works on national security issues with a federal agency or if polygraph examinations are required by the federal agency. Government Code, Section 411.007 (c-1), section 2 could remove or deny an assignment from DPS commissioned officers and noncommissioned employees who refuse to take a polygraph examination required for a position involving a joint state and federal investigation or a national security issue.
 
DPS states that there would be no significant fiscal impact to the agency from implementing the provisions of the bill.
 
The bill would take effect on September 1, 2007.
 
DPS states that there would be minimal operational costs associated with implementing the provisions of the bill; therefore costs would not be significant.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
