No fiscal implication to the State is anticipated.
The bill would amend Section 601.261, Transportation Code, to authorize rather than require a court to order a motor vehicle impounded upon the owner's second or subsequent conviction for operating a motor vehicle without financial responsibility for the vehicle. The bill would also add the chief of police of the municipality in which the court is located to whom the court may issue the order for impoundment. Under current statute, only the county sheriff is listed as the government entity that can be required by the court to impound the vehicle.
