The bill amends the Health and Safety Code relating to the use of electronically readable information on a driver's license or personal identification certificate in connection with the over-the-counter sale of ephedrine, pseudoephedrine, or norpseudoephedrine; providing a criminal penalty. The bill allows a business establishment engaged in selling an over-the-counter product containing ephedrine, pseudoephedrine, or norpseudoedrine to use the electronically readable information on a driver license, commercial driver license, or personal identification certificate. The bill prohibits the sale of this information. This bill allows the Department of State Health Services (DSHS) and the Department of Public Safety (DPS) to obtain this information by request or through a court order. The bill would take effect immediately if two-thirds of the House of Representatives and Senate members vote to enact the legislation. If it does not receive the vote necessary for immediate impact, the bill would take effect on September 1, 2007.
DPS and DSHS have both determined that the cost of implementing the provisions of the bill would not be significant. It is assumed that any additional costs can be absorbed within each agency’s current appropriations.
