No significant fiscal implication to the State is anticipated.


The bill would amend various sections of the Health and Safety Code and require the Department of Aging and Disability Services (DADS) to conduct the additional exit conference (required by current law if any additional violations at a nursing facility, assisted living facility or intermediate care facility for persons with mental retardation are discovered during review of field notes or preparation of the final list) in person and not via telephone, e-mail or fax. The bill also clarifies the 10-day timeframes for submission of a plan of correction for state licensure violations by the facilities as 10 working days after the facility receives the final official statement of violations. In addition, the bill includes provisions relating to temporary change of ownership licenses for nursing home facilities. DADS indicated there could be an additional General Revenue cost starting at $19,518 for fiscal year 2008 with a slight increase to $24,189 by fiscal year 2012.
