LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 6, 2007

TO:
Honorable Kevin Bailey, Chair, House Committee on Urban Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB350 by Ellis (Relating to a request for a public hearing before requiring the abatement of certain nuisances.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend Section 683.074(b)(2), Transportation Code, by changing the requirements associated with holding a public hearing before removing a public nuisance. Under current statute, a public hearing is required prior to removal of the nuisance; under the proposed legislation, a public hearing would be required only on request of a person who receives notice the nuisance must be abated and removed.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
