No fiscal implication to the State is anticipated.

The bill would amend Section 683.071, Transportation Code, to change the definition of "junked vehicle" to a vehicle that does not have a lawfully attached unexpired license plate and a valid motor vehicle inspection certificate. Under current statute, the definition indicates that the vehicle does not have one or the other. This change could reduce the number of vehicles classified as junked, and therefore reduce the number of vehicles requiring abatement as a nuisance.

The bill would amend Section 683.074(b)(2), Transportation Code, by changing the requirements associated with holding a public hearing before removing a public nuisance. Under current statute, a public hearing is required prior to removal of the nuisance; under the proposed legislation, a public hearing would be required only on request of a person who receives notice the nuisance must be abated and removed, which could reduce the number of hearings required.
