No fiscal implication to the State is anticipated.

The bill would add Section 643.209 to Subchapter E, Chapter 643 of the Transportation Code to authorize the sheriff's office in certain counties to maintain a list of towing companies to perform nonconsent tows of motor vehicles initiated by a peace officer investigating a traffic accident or incident. Related procedures are specified in the bill, including authorizing the sheriff's office to assess a towing company an administrative fee to be included on the tow rotation list in an amount not to exceed the amount necessary to implement the Section.

If a person violates the county's policies related to the tow list rotation, it would be a misdemeanor offense punishable by a fine of between $1 and $200.

The bill would take effect September 1, 2007.


Local Government Impact

The counties to which the bill would apply are Fort Bend, Jasper, Nacogdoches, Sabine, San Augustine, and Shelby.

No significant fiscal implication to units of local government is anticipated.
