LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 1, 2007

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB514 by Hegar (Relating to the confidentiality of certain information of a person licensed to practice law held by governmental bodies.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 552, Government Code, to add an exception to disclosure of information that relates to the home address, home telephone number, electronic mail address, social security number, or date of birth of a person licensed to practice law in Texas if the person notifies a governmental body of the attorney's choice in writing or electronically on a form provided by the governmental body that the person chooses to restrict public access. The notification would remain valid until rescinded in writing or electronically by the person. Documents filed with the county and district clerks would be exempt.

The bill would take effect on September 1, 2007.

This analysis assumes that a governmental body notified by an attorney to maintain confidentiality of personal information maintains the specified information in the governmental body's records and is not responsible for maintaining confidentiality of records held by another governmental body the attorney could have selected.

The OAG anticipates any additional work resulting from the passage of the bill could be reasonably absorbed with current resources.

Local Government Impact

It is anticipated that a local governmental entity would be able to implement provisions of the bill using existing resources.

No significant fiscal implication to units of local government is anticipated.
