LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 31, 2007

TO:
Honorable Florence Shapiro, Chair, Senate Committee on Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB883 by Deuell (Relating to the imposition of impact fees on the property of a school district.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Section 395.022, Local Government Code, to provide a school district's board of trustees discretion for whether a school district would pay impact fees on the district's property under Chapter 395 (related to financing capital improvements required by new development in municipalities, counties, and certain other local governments).

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

Local Government Impact

The fiscal impact would vary by school district and other political subdivision depending on the amount of property involved and whether a school board is willing to enter into a contract with the political subdivision to pay impact fees and, if so, in what amounts.
