LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 17, 2007

TO:
Honorable Robert Duncan, Chair, Senate Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB972 by Van de Putte (Relating to prohibiting the sale or use of unsafe children's products; providing a civil penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add a chapter, Children's Products Safety, to Subtitle A, Title 9, Health and Safety Code that requires the Department of State Health Services (DSHS) to maintain a list of unsafe children's products on its website. The Department of Family and Protective Services (DFPS) is required to notify a child-care facility of the provisions of the chapter at the time the facility submits an application for a license or a renewal and during a monitoring visit.

Both DSHS and DFPS indicate that they could absorb the costs associated with the bill within their current resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
