LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 3, 2007

TO:
Honorable Jeff Wentworth, Chair, Senate Committee on Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1015 by Whitmire (Relating to the application of the doctrine of sovereign immunity in a judicial proceeding to enforce certain employment rights.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would add Section 180.007 to Chapter 180 of the Local Government Code to waive sovereign immunity regarding allegations related to monetary benefits of a current or former fire fighter or police officer covered by certain codes who is or was employed by a municipality with a population of 1.9 million or more.

Local Government Impact

Based on the 2000 U.S. Census, the bill would apply only to the City of Houston.

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
