IN RE: | SB1072 by Janek (Relating to the delivery of a child taken into custody under the juvenile justice system to a school official.), Committee Report 1st House, Substituted |
The bill would amend Family Code, Section 52.02(a) by adding the provision that a person taking a child into custody may bring the child to the school campus to which the child is assigned if school is in session and the principal, the principal's designee or a peace officer assigned to the campus agrees to assume responsibility for the child the remainder of the school day. The law enforcement officer who has taken the child into custody would be responsible for delivering the child to the child's assigned school campus if the child is not released to a parent, guardian or custodian, or placed in a detention facility. The bill would take effect September 1, 2007.
