No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to access to criminal history record information by certain county attorneys.

The bill would add Government Code, Chapter 411, Subchapter F, Access to Criminal History Record Information: County Attorney in a County with a Population of 3.3 Million or More, which states a county attorney in a county with a population of 3.3 million or more is entitled to obtain from the Department of Public Safety (DPS) criminal history record information maintained by the agency relating to:  a matter falling within the authority of the county attorney as specified by Section 45.201; or a person who is an applicant for employment by the county. The bill would take effect immediately if two-thirds of the House of Representatives and Senate members vote to enact the legislation.  If it does not receive the vote necessary for immediate impact, the bill would take effect on September 1, 2007.

DPS anticipates no significant fiscal impact to the agency. 


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
