The bill would amend the Health and Safety Code and the Code of Criminal Procedure relating to the civil commitment of sexually violent predators by the civil division of the Special Prosecution Unit of Walker County. The bill would provide that an assigned judge in civil commitment proceedings is not subject to most objections, as described. The bill would create an offense for failing to comply with a civil commitment requirement. The bill would clarify that local prosecutors can seek assistance from the Special Prosecution Unit of Walker County in prosecution violations of civil commitment requirements. To the extent the bill would change court procedures regarding civil commitments, no significant fiscal implication to the State is anticipated. The bill would take effect September 1, 2007.
