This bill would amend the Code of Criminal Procedure to make certain persons that had been overpaid crime victims compensation liable for the overpayment. The bill would require repayment of the overage to General Revenue-Dedicated Compensation to Victims of Crime Account No.0469. The bill would establish procedures for written notice of liability, administrative remedy, and judicial review. The Attorney General would be entitled to recover all expenses incurred for an ordered repayment.
The bill would authorize the Attorney General to certify, to the Comptroller, any overpaid crime victims’ compensation as a debt for the purpose of prohibiting state payments to the debtor until the debt is repaid. The Comptroller would be authorized to certify the debt amount to the Attorney General for collection. In addition, the bill would allow interest to be paid to persons who had been determined, by administrative hearing or judicial review, to have repaid an amount in excess of the amount actually owed.
It is assumed that any additional costs associated with implementation of the bill could be absorbed within existing state resources. Any additional reimbursements gained as a result of the provisions of the bill would not be significant.
