No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code, the Local Government Code, and the Government Code relating to the performance of certain civil duties by officers in the State.  The bill would amend guidelines for determining whether an officer is liable for refusal or neglect in performance of duties.  The bill would amend guidelines relating to improper handling of writs, failure to levy or sell property, failure to deliver monies collected, claims for damages against officers, and surety bonds as described.  To the extent the bill would amend court procedures regarding civil duties of officers, no significant fiscal implication to the State is anticipated.

 

The bill would take effect September 1, 2007.
