No significant fiscal implication to the State is anticipated.
The bill would require the Texas Commission on Environmental Quality (TCEQ) to write rules to require recyclers with combustible materials to recycle or transfer 50 percent of the material received within a 12-month period; recycle or transfer half of the processed or unprocessed materials accumulated within a 12-month period; and limit the size of a pile of composting materials, recycling materials, or mulch allowed at a solid waste processing facility, including a composting, recycling or mulching facility. The requirements would not apply to a facility operating under a municipal solid waste permit or a facility owned or operated by a local government. Rules promulgated by the TCEQ would be required to conform to the International Fire Code as it existed on May 1, 2007. If a facility is not in compliance with the proposed provisions, the TCEQ would be required to conduct an annual review and inspection of the facility. A rule adopted by the TCEQ to implement the bill would not become effective until the first anniversary of the date on which the rule was adopted.
