No significant fiscal implication to the State is anticipated.

The bill would add section 552.0215 to the Government Code. Under the proposed section, information that is not confidential but is excepted from required disclosure would become public information on or after the 75th anniversary of the date the information was originally created or received by a governmental body. Information that is confidential by law would maintain its confidentiality.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

The Office of the Attorney General states that at most, passage of the bill would only change the agency's analysis of information, but that it would not otherwise affect the agency's workload.

It is anticipated that the fiscal impact for other state agencies responsible for maintaining records would not be significant.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
