LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 1, 2007

TO:
Honorable Patrick M. Rose, Chair, House Committee on Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1318 by Janek (Relating to the regulation of adult day-care facilities and certain long-term care facilities, including the establishment of late fees and changes to administrative penalties, and relating to the office of the state long-term care ombudsman.), As Engrossed

No significant fiscal implication to the State is anticipated.

The Health and Human Services Commission anticipates any additional work resulting from the
passage of the bill could be reasonably absorbed within current resources.

Under provisions of the bill license fees would be increased from $25 per year to $50 for two years for adult day care facilities; from a range of $300 to $1,000 per year to a range of $600 to $2,000 for two years for home and community support services agencies; and from a maximum of $750 per year to a maximum of $1,500 for two years for assisted living facilities.

Changes affecting license fees and late penalties would apply to license renewal applications filed on or after November 1, 2007.

The Comptroller of Public Accounts indicates that the revenue impact of the fee changes can not be estimated.

Local Government Impact

No fiscal implication to units of local government is anticipated.
