LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 7, 2007

TO:
Honorable John Carona, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1368 by Carona (Relating to the protective headgear requirements for motorcycle operators and passengers.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to increase from a range of between $10 and $50 to between $500 and $1,500 the fine for a misdemeanor offense related to protective headgear requirements for motorcycle operators and passengers.

The proposed change in statute would apply only to an offense committed on or after the effective date of the bill, which would be June 1, 2008.

Local Government Impact

The impact would vary by local government depending on how many offenses are committed and the amount of fine imposed; however, the increase in fine levels would result in a significant increase in revenue per offense, although the total revenue gain would not likely be significant compared to overall local government budgets.
